Supreme Court Strikes Down CDC Eviction Ban

On August 26, 2021, the United States Supreme Court struck down the Center for Disease Control’s (CDC) federal eviction moratorium, declaring it unconstitutional. Any landlords with cases on hold due solely to receipt of a CDC declaration may now proceed with termination of tenancy due to non-payment.

But, it is very important to note that the state eviction protections still remain in place and landlords must follow all state laws regarding protection for renters.
