January 2021 Forms Update

At a minimum, the Multifamily NW Forms Collection is updated four times a year, at the start of each quarter. In recent years, that pace has doubled and even tripled as the Multifamily NW Forms Committee and legal team quickly pivot to accommodate the steady legal changes coming from local and state jurisdictions.

Below we’ve detailed the Forms Collection updates as of January 2021, many from HB 4401 which passed during the 3rd Special Session of the Oregon Legislature in December of 2020. Click the links to view sample copies of the forms.

1st Quarter Forms Update - (January 1st, 2021):

OREGON:

M001 OR Rental Agreement 
M201 OR Single Family/Condo/Multiplex Rental Agreement 

References to the Terms and Conditions on page 1 and 2 have been changed to name the section title instead of the section number. This was done to reduce errors that happen inadvertently when new sections are added and the Terms and Conditions are renumbered.

M008 OR Statement of Deposit Accounting (Not for Portland) 
M528 OR Statement of Deposit Accounting (Portland)
M529 OR Statement of Final Accounting (No Security Deposit) (Portland)

The HUD Disclosure was removed in order to comply with new legislation. HUD users should evaluate compliance requirements before pursuing balance delinquencies after tenants move out.

M015 OR 13-Day Notice of Termination for Nonpayment of Rent

Due to the pandemic, this form was changed from a 144-hour notice to a 13-day notice and reinstated for use in Oregon, but it should NOT be used in the City of Portland or in Multnomah County.

M020 OR 10-Day Notice of Termination for Nonpayment of Rent 

Due to the pandemic, this form was changed from a 72-hour notice to a 10-day notice and reinstated for use in Oregon, but it should NOT be used in the City of Portland or in Multnomah County.

M176 OR Emergency COVID-19 Balance Reminder (Not a Bill or Invoice) 

The emergency period language was rewritten to comply with the new dates, as provided in HB 4401 and Multnomah County Ordinance 1287.

M177 OR HB 4213 Emergency COVID-19 Grace Period Notice 

FORM REMOVED – This form is no longer available.

M180 OR Notice of Eviction Protection 

NEW FORM! – The State of Oregon is requiring that this new form be attached to the following termination notices: 10-Day, 13-Day, and other for-cause notices for nonpayment. It should also be attached to the COVID-19 Balance Reminder.

M181 OR Declaration of Financial Hardship for Eviction Protection 

NEW FORM! – The State of Oregon is requiring that this new form be attached to the following termination notices: 10-Day, 13-Day, and other for-cause notices for nonpayment. It should also be attached to the COVID-19 Balance Reminder.


OREGON/WASHINGTON:

 

M048 OR-WA Utilities Set-Up and Transfer Agreement

Minor changes were made to increase usability by landlords who want to fill out the account numbers before sending this form to the residents.

M061 OR-WA Non-Tenancy Acknowledgment for Third-Party Payments

NEW FORM! – This form can be used for receiving payment(s) from a third party. It acknowledges that no landlord-tenant relationship is being created with the third party; that no terms of the Rental Agreement are being altered; and that the Owner/Agent has no obligation to accept future rent payments from the third party.
