2018 2nd Quarter Special Update - Portland Relocation (May):

OREGON:

M001 OR Rental Agreement

- The box on page one in the Tenancy section which provided for an automatic rent increase at the end of a fixed term was deleted. It was causing issues with the City of Portland relocation ordinance and the reason it was originally added (addressing an ambiguity in the statute prohibiting rent increases during the first year of a month to month tenancy) has largely gone away.

- An “Automatic Expiration” option was added to the Tenancy section on page one allowing a fixed-term to terminate automatically at its expiration, without rolling to month-to-month. Thus, if a new fixed-term is offered on substantially the same terms as the expiring lease, and is not accepted by the tenant, the automatic expiration avoids the City of Portland relocation assistance payment as no termination notice need be issued.

- Section 6 of the terms and conditions was modified to match the changes listed above.

M201 OR Single Family/Condo/Multiplex Rental Agreement

M002 OR Rental Application 

- The following checkbox was added to page 2: "If checked, applicant is hereby notified that the tenancy will be fixed term and it is Owner's intent to sell the dwelling unit or permanently convert the dwelling unit to a use other than as a dwelling unit."

M011 OR Notice of Rent/Monthly Charges Increase 

- A reminder was added for managers with units in the City of Portland to attach form M170, Notice of City of Portland Renter Additional Protections. The attachment is a new requirement under the City of Portland relocation ordinance.

- The following note was added: "City of Portland relocation assistance is due only if the rent increase is 10% or more in the last rolling 12-month period."

M049 OR 90-Day End of Tenancy Notice 

- A reminder was added for managers with units in the City of Portland to attach form M170, Notice of City of Portland Renter Additional Protections.

M065 OR Renewal Offer/Rent Increase Notice 

- A reminder was added for managers with units in the City of Portland to attach form M170, Notice of City of Portland Renter Additional Protections.

- The following note was added: "City of Portland relocation assistance is due only if the rent increase is 10% or more in the last rolling 12-month period."

M067 OR Fixed-Term Renewal Offer 

- A reminder was added for managers with units in the City of Portland to attach form M170, Notice of City of Portland Renter Additional Protections.

- The following note was added: "City of Portland relocation assistance is due only if the rent increase is 10% or more in the last rolling 12-month period."

M170 OR Notice of City of Portland Renter Additional Protections 

NEW FORM! – This form is required to be provided any time you issue a no-cause termination notice, a rent increase notice of 5% or more, or make a relocation payment.

M171 OR Relocation Assistance Payment Receipt 

NEW FORM! – Use this form if you make a relocation assistance payment to a resident.
